1. Who we are

In The Sky IT Ltd ("we", "us", "our") is a company registered in England and Wales under company number 16313322, with its registered office at Centre Park, 320 Firecrest Ct, Warrington, WA1 1RG and its trading address at 184 Horton Road, Manchester, M14 7QF. Our VAT registration number is 490850179.

 

We are an IT consultancy providing digital transformation, IT strategy and governance, AI readiness, cloud solution architecture, cloud infrastructure and DevOps, web design and build, and website and social management services to small businesses, startups and non-profit organisations.

 

We are the data controller for personal data collected through this website and in the course of running our business. You can contact us about anything in this policy at contact@basementinthesky.com or on 0161 884 0705.

2. The personal data we collect

Data you give us. When you submit our contact form, book a consultation or email us, we collect your name, email address, and any telephone number, organisation name or other details you choose to provide, together with the description of what you would like help with.

 

Data we collect automatically. Our hosting provider records standard technical information when you visit this site, including your IP address, browser type, operating system, the pages you viewed and the site you arrived from. This is used for security and for keeping the site running. We do not use it to identify you.

 

Data we receive during an engagement. If you become a client, we will hold the contact details of the people we work with at your organisation, together with correspondence and records relating to the work.

3. Why we use it, and our legal basis

To respond to your enquiry. Our legal basis is legitimate interests: we have a legitimate interest in replying to people who have contacted us voluntarily, and you would reasonably expect us to.

 

To provide and manage our services. Our legal basis is performance of a contract, or steps taken at your request before entering into one.

 

To keep proper business records and meet our legal duties. Our legal basis is legal obligation, including our obligations under tax and company law.

 

To protect our website and systems. Our legal basis is legitimate interests in maintaining the security and availability of our services.

 

We do not carry out automated decision-making or profiling. We do not send marketing email to people who have not asked for it, and any marketing we do send will always include a way to stop it. We do not sell, rent or trade personal data, and we never will.

 

4. Cookies

This website uses only cookies that are strictly necessary for it to function. We do not use analytics, advertising, tracking or social media cookies, which is why you are not asked to accept anything when you arrive.

 

If that changes, we will update this policy and ask for your consent before any non-essential cookie is set, as required by the Privacy and Electronic Communications Regulations.

 

5. Who we share it with

We share personal data only where it is necessary, and only with:

 

•   Our IT and email providers, whose systems carry our correspondence. Our email is hosted on Microsoft 365.

•   Subcontractors and associates, where a piece of work needs a specialist. They are bound by equivalent confidentiality and data protection obligations, and we remain responsible to you for their work.

•   Our professional advisers, such as our accountant, where necessary.

•   Regulators, courts and public authorities, where we are required by law to disclose information.

 

We do not share personal data with anyone else, and no one pays us for access to it.

6. When we handle data on your behalf

Much of our work involves access to systems that contain personal data belonging to our clients: email tenancies, cloud environments, websites and customer records. When we do that, you remain the controller of that data and we act as your processor. That relationship is governed by our Trading Terms and by a written data processing agreement, which sets out what we may do with the data, how we protect it, and what happens to it when the engagement ends.

 

We do not use client data for our own purposes. We do not retain copies of it beyond what is necessary to do the work.

 

7. Where your data is held

We aim to keep personal data within the UK and the European Economic Area. Some of the service providers we rely on, including Microsoft, may process data outside the UK. Where that happens, the transfer is covered by the safeguards recognised under UK data protection law, such as the UK International Data Transfer Agreement or an adequacy decision.

 

8. How long we keep it

Enquiries that do not become engagements are deleted after 24 months. Records relating to clients are kept for six years from the end of the business relationship, which is the period we need for tax, accounting and legal purposes. Access to client systems is removed at the end of an engagement.

 

9. Your rights

Under UK data protection law you have the right to ask us for a copy of the personal data we hold about you, to have inaccurate data corrected, to have data erased where there is no longer a lawful reason for us to hold it, to restrict how we use it, to object to processing we carry out on the basis of legitimate interests, and to receive certain data in a portable format.

 

To exercise any of these, email contact@basementinthesky.com. We will respond within one calendar month. We may need to confirm who you are before we act.

 

If you are unhappy with how we have handled your data, please tell us first and we will try to put it right. You also have the right to complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.

 

10. Security

We take appropriate technical and organisational measures to protect personal data, including multi-factor authentication on our accounts, encrypted storage and transmission, and access limited to those who need it. No system is perfectly secure, but we take this seriously and we will tell you promptly if something goes wrong that affects you.

 

11. Changes to this policy

We update this policy from time to time. The date at the top shows when it last changed. If we make a material change we will say so clearly.
